We've all set foot inside a Walmart at one time or another. I know a bunch of my paycheck is spent there. It's a place where you can get just about anything and see just about anything too. There's no secret that you'll find an array of different folks inside a Walmart. No judgment here, however, I know I'm not the only one who has noticed some pretty strange happenings while doing my grocery shopping. The things you see at Walmart, am I right?

Such was the case recently. I was in doing some quick shopping. I noticed a man coming from the hot deli area making his way toward me. He was eating a corn dog. That's cool. I've seen folks have a quick snack while shopping before. What I witnessed next is what floored me.

We ended up going down the same aisle where you find all the condiments. This man walked up to a new bottle of mustard, opened it, and squirted some on his corn dog. I had to do a double-take. Is that legal to do, before the item is paid for? Is it considered shoplifting or just not cool?

According to the legal resource website Find Law, 2 things have to occur before an item is considered shoplifting.

  • Taking possession of an item that is for sale
  • The intent to permanently deprive the rightful owner without paying for it

So, in other words, one would not only have to take the item but also evade checkout for legal measures to be taken. I couldn't find a law anywhere that specifically addresses the consumption of new food items while shopping. Does that mean if you have the intent to pay for it, it's alright to do?

Be careful with your snacking inside the store, especially when it comes to opening new packages before paying for them. If you're detected "grazing" while shopping it's possible you could get flagged by an employee like a cashier or loss prevention officer. Being detained until things are straightened out may not be the way you want to spend your time.
